Terms and Conditions
1. General
These Terms and Conditions apply to all services, estimates, quotations, invoices, and contracts provided by Hermes Plumbing & Heating Service Ltd. ("Hermes Plumbing & Heating," "we," "our," or "us"). By requesting, scheduling, or authorizing services, the client ("you" or "customer") agrees to be bound by these Terms and Conditions.
2. Estimates & Quotes
- All estimates and quotes are provided based on visible conditions at the time of assessment.
- Estimates are not guaranteed prices unless expressly stated in writing as a fixed-price agreement.
- Additional work required due to concealed or unforeseen conditions (including but not limited to hidden leaks, code violations, structural issues, or outdated systems) will be communicated and billed separately upon approval.
- Estimates are valid for 30 days unless otherwise stated.
3. Scope of Work
- Work will be performed according to the agreed scope outlined in the estimate, quote, or work order.
- Any changes or additions requested by the client may result in additional charges and timeline adjustments.
4. Pricing & Payment Terms
- Payment is due upon completion of work unless otherwise agreed to in writing.
- Invoices not paid within 14 days may be subject to interest charges of 2% per month (24% annually).
- Hermes Plumbing & Heating reserves the right to suspend or refuse service for overdue accounts.
- The customer is responsible for all costs associated with the collection of overdue accounts, including legal and administrative fees.
5. Deposits
- Deposits may be required for larger projects, special-order materials, or installations.
- Deposits are non-refundable once materials have been ordered or work has commenced.
6. Cancellations & Missed Appointments
- A minimum of 24 hours’ notice is required for cancellations or rescheduling.
- Missed appointments or late cancellations may be subject to a service or call-out fee.
7. Emergency Services
- After-hours, weekend, and emergency services are billed at premium rates.
- Emergency service fees apply regardless of whether repairs are completed.
8. Warranties
- Hermes Plumbing & Heating Service Ltd. hereby warrants that all labour performed in connection with plumbing and heating services shall be free from defects in workmanship for a period of one (1) year from the date of substantial completion of the work.
- This labour warranty is limited strictly to workmanship and excludes materials, fixtures, parts, or equipment unless otherwise specified in writing.
- Any equipment or materials supplied are subject solely to the applicable manufacturer’s warranties and the terms and conditions set forth therein.
- This warranty shall not apply to, and Hermes Plumbing & Heating Service Ltd. shall not be responsible for, any damage, defect, or failure arising from misuse, neglect, normal wear and tear, unauthorized repair or modification, freezing, corrosion, improper or inadequate maintenance, or events beyond reasonable control, including acts of God.
9. Client Responsibilities
- The client must provide safe, clear, and reasonable access to the work area.
- The client is responsible for removing or protecting personal belongings near the work area.
- Delays caused by lack of access or unsafe conditions may result in additional charges.
10. Permits & Code Compliance
- Where required, Hermes Plumbing & Heating will obtain applicable permits unless otherwise agreed.
- All work will be completed in compliance with applicable local and provincial codes at the time of installation.
11. Liability Limitations
- Hermes Plumbing & Heating shall not be liable for indirect, incidental, or consequential damages.
- Liability for any claim shall not exceed the total value of the services provided.
- We are not responsible for pre-existing conditions or failures beyond the scope of work.
12. Property Damage
- Reasonable care will be taken during work; however, some damage (such as drywall, flooring, or finishes) may be unavoidable.
- Repairs to finishes are not included unless specifically stated in writing.
13. Force Majeure
Hermes Plumbing & Heating is not responsible for delays or failure to perform due to circumstances beyond our control, including weather, supply shortages, labour disruptions, or acts of God.
14. Termination of Services
We reserve the right to terminate services if payment terms are not met, unsafe conditions exist, or the client behaves in an abusive or inappropriate manner toward staff.
15. Governing Law
These Terms and Conditions are governed by the laws of the Province of Alberta.
16. Acceptance of Terms
Authorization of work, whether written, verbal, electronic, or implied, constitutes acceptance of these Terms and Conditions.
